In what cases is mediation mandatory before going to court?

I have a question - maybe someone has encountered this. My ex and I couldn't agree about the children, and I was already thinking about going to court. But then they told me that it was necessary to go through mediation before that. At first, I didn't understand why and who decided this. In the end, we went to MIAM (this is like an introductory meeting before mediation), and only then did they give the go-ahead to file a lawsuit. Maybe this is not necessary in all cases? Can someone explain when this is really necessary?

Yes, I've been through this too. In most cases, when it comes to children or finances after a divorce, the court requires that the parties first try to reach an agreement through mediation. This is sort of a goodwill move to avoid unnecessary burden on the system and save time. I had a similar case - I couldn't divide housing and custody with my ex. We were told that without MIAM they wouldn't even accept the application. In the end, we went, and honestly - a lot became clear. I'm sitting here, reading and thinking how much everything has changed. Previously, no one had even heard of such things, and now mediation is almost a mandatory step. But in general, the idea is sound - it's better to talk and try to come to an agreement than to run straight to court. Maybe this really does help someone save their nerves and money. Interesting topic, thanks for raising it.
